Marital rape can be a reason for divorce: Kerala High court

The Kerala High Court ruled that by recognizing marital rape as a cruel form, marital rape can be used as a ground for granting divorce. The Supreme Court rejected a petition that included rape as a ground for divorce in 2019. The High Court made a ruling while hearing the husband’s appeal against the divorce approved by the Family Court in 2014. Treating the wife’s body as something owed to her husband and engaging in sexual acts against her husband’s wishes is nothing more than marital rape. The right to respect for their physical and mental integrity includes physical integrity; any disrespect or violation of physical integrity is an infringement of personal autonomy…”, the High Court said.
